(12/071) The case on Dağlıca attack…
On 11 December 2009 Van Gendarmerie Security Corps Headquarters Military Court went on hearing the case against the eight soldiers who were abducted by Kurdistan Workers’ Party’s (PKKKurdish Workers' Party ) armed wing People’s Defence Forces (HPGPeople's Defence Forces (armed wing of the PKK) ) in Dağlıca attack in which 12 soldiers were killed in Yüksekova District of Hakkâri Province on 21 October 2007. The court adjudicated to annul the ban of publication decision on the case and postponed the hearing to 25 December 2009 to evaluate the demands of the prosecutor (ntvmsnbc.com, 11 December).

Şevket Arslan who had been wounded in the armed attack of the right-wingers to the protestors in front of the Democratic Society Party’s (DTP) Province Branch building in Dolapdere Quarter of Beyoğlu District of İstanbul Province on 13 December 2009 was arrested on 15 December 2009 and the three perpetrators of the armed attack were released after a short period of time in detention.
Law enforcement officers interfered the demonstration to protest the closure of DTP with pressured water and gas bombs in Diyarbakır Province on 13 December 2009. Three people were wounded and 11 people were detained in the intervention.
Sixteen out of the 31 detainees in Van Province who had been detained on 10 December 2009 and seven people in Yüksekova District of Hakkâri Province were arrested on 14 December 2009 in connection with the demonstrations to attract attention to the prison conditions of Abdullah Öcalan in İmralı F Type Closed Prison (ANF, 13-15 December; Radikal, 13 December; Zaman, 12-13-14 December; Gündem, 12 December; sesonline.net, 14 December).

Muhyettin Özer’s tongue was cut off with surgical operation due to the excessive use force by the police officers in the demonstration in Siirt Province 6 December 2009.
Three people who had been detained in connection with the demonstrations to attract attention to the prison conditions of Abdullah Öcalan in İmralı F Type Closed Prison in Bingöl Province on 12 December 2009 were arrested on 14 December 2009.
Thirty-one people in Şanlıurfa Province, 12 juveniles in Batman Province, six people in Erciş District of Van Province, a person in Patnos District of Ağrı Province were arrested on 10 December 2009 and 32 people in Iğdır Province on 13 December 2009 (ANF, 10 December; Gündem, 13 December; Milliyet, 14 December).

H.K. (16) whose right side had been paralysed, was beaten as he was apprehended in the protest in Silvan District of Diyarbakır Province on 11 December 2009. He faced with psychological torture in District Security Directorate during his detention (ANF, 14 December).

Musa Ayhan was seriously beaten by law enforcement officers in front of the cameras during the intervention of the officers to the protest in Yüksekova District of Hakkâri Province on 13 December 2009. Musa Ayhan and six other detainees were still in District Security Directorate without medical treatment (ANF, 13 December).
B.K.’s (15) right eye lost its sight with the hit of a hard object in the in the intervention of law enforcement officers to the protest in İstanbul Province on 13 December 2009 (Gündem, 14 December).
C.A. (10) and M.S. (13) were seriously wounded with the fire of police teams in the intervention of to the protest in Hakkâri Province on 12 December 2009 (Gündem, 12 December).

Two Kurdish, Selçuk University’s students -Şehmus Tosun and Remzi Akpolat- were abducted by right-wingers in and tortured in an isolated field in Seydişehir District of Konya Province on 11 December 2009 (Gündem, 12 December).

Right wingers attacked on Yusuf Çalış from Hakkâri Province, student of Kocatepe University in Afyon Province on 8 December 2009. He did not wound in the attack because he was close to the dormitories (Gündem, 9 December).

E.E.’s (11) family made an official complaint against the music teacher C.K. on the grounds that he had beaten their chid in Marmaris District of Muğla Province on 9 December 2009. Hit marks were documented on the left leg of E.E. (Milliyet, 9 December).

The director of Kilimli Anatolian High School (in Zonguldak Province) Münür Dilbaz, was imaged as he was beating 30 students on the grounds that they ran away from school for a volleyball match on 10 December 2009. Zonguldak Security Directorate’s Juveniles Department launched an investigation against the director with the official complaints of the five families (Evrensel, 12 December).

Adana Security Directorate’s Fighting with Terrorism Department police teams had raided on Radio Dünya with the decision of Adana Heavy Penal Court No. 8 and detained 24 people including Kenan Karavil, Radio Dünya’s editor in chief, Şeyhmus Bilgin, a reporter of Günlük ve Azadiya Welat Newspapers, Seyithan Akyüz, Adana representative of Azadiya Welat Newspaper, DTP executives Erol Demirhan and Engin Okutucu and DTP workers Fikriye Özbay and Hazım Bahadır on 7 December 2009. Kenan Karavil, Şeyhmus Bilgin were arrested on charges of “making propaganda of an illegal organisation” 11 December 2009 (bianet.org, 11 December).

İstanbul Heavy Penal Court No. 14 adjudicated to confiscate all issues of the book Nationalism: A Decease of Civilisation (Bir Uygarlık Hastalığı: Milliyetçilik) written by Sinan Şahin and published by Aram Press on charges of “making propaganda of an illegal organisation” under Article 25/2 of Media Law on 14 December 2009 (Günlük, 14 December).

Tunceli Penal Court of Peace sentenced DTP’s Tunceli Province Branch chairperson Özgür Söylemez and vice chairperson Süleyman Yurtdaş to a fine of 500 TL each on the grounds that they shouted “Biji Serok Apo” slogan in a protest on 16 September 2008 on charges of “praising crime and criminal” under the Article of 215/1 of TPCTurkish Penal Code on 8 December 2009. Ali Ulufer was acquitted in the case (bianet.org, 9 December).

Diyarbakır Heavy Penal Court No. 6 sentenced 24 people, including Adnan Etli, DTP’nin Viranşehir District (of Şanlıurfa Province) Branch chairperson, to 12 months of imprisonment each in connection with a public statement to protest the incidents in Diyarbakır Province in March 2006 in Şanlıurfa Province on charges of “making propaganda of an illegal organisation” under Article 7/2 of Fighting with Terrorism Law on 14 December 2009 (ANF, 14 December).

Elazığ Penal Court of First Instance No. 2 sentenced Baki Yıldırım, DTP’s Elazığ Province Branch chairperson to 6 months and 7 days of imprisonment in connection with referring Abdullah Öcalan as “honourable” in a public statement in 2008 on charges of “praising crime and criminal” under the Article of 215/1 of TPC on 11 December 2009. The sentence then commuted to a fine of 3740 TL (Radikal, 13 December).

Police teams raided on the office of the Confederation of the Revolutionary Workers Trade Unions’ (DİSK) Revolutionary Land Transport Workers’ Trade Union (Nakliyat-İş) and the houses of the members and executives of trade union on 7 December 2009 and detained 14 executives and members of the trade union. Ten members of the union were arrested, including the chairperson of the Nakliyat-İş, Ali Rıza Küçükosmanoğlu, on charges of “hindering the freedom of work of one or more people” on 10 December 2009(bianet.org, 15 December).

Lawyer of the Özgür Yurttaşlığı Geliştirme Derneği (ÖYDER) Asya Ülker stated that police teams raided on the office of the association in Ümraniye District of İstanbul Province violating the rules of a raid in the midnight of 10 December 2009 and confiscated some documents (Gündem, 10 December).
