(09/031) Human rights violations and attacks in the process of Referendum on 12 September 2010…
Retired teacher İlhan Piyan’ın (58) was beaten by two unidenfied persons as he intended to put down the placard of Justice and Development Party (AKPJustice and Development Party ) in front of his house in Denizli Province on 6 September 2010. İlhan Piyan’s left arm was fractured and the perpetrators were released after giving testimonies (Milliyet, 8 September).
The members of the AKP were beaten by unidentified persons as they were handing out leaflets for the referendum in Şirinyer Quarter of Buca District of İzmir Province on 9 September 2010. Republican People Party (CHPRepublican People's Party ) youth Branch member S.Y. was detained in connection with the incident and released after giving his testimony (Radikal, 9 September).
Twelve people were detained in the operations against the people who have been performing referendum activities for Peace and Democracy Party (BDPPeace and Democracy Party ) in Batman Province on 11 September 2010 (ANF, 11 September).
Police teams hindered four members of the Labor Party (EMEPLabour Party ) who intended to hang posters in Denizli Province on 6 September 2010 and imposed a fine of 532 TL each according to the Law of Petty Offences (Evrensel, 8 September).
Thirteen out of the 20 detainees who had been detained in home raids of the BDP members in Doğubayazıt District of Ağrı Province on 9 September 2010 were arrested on 11 September 2010 (ANF, 11 September).
Thirty-two people in Gaziosmanpaşa, Pendik, Bağcılar and Sultangazi Districts of İstanbul Province, 22 in Van Province, 16 in Hakkâri Province, 15 in Yüksekova District, 5 in Şemdinli District and 8 in Adana Province were detained in home raids of Fighting with Terrorism Department teams on 11 September 2010 (ntvmsnbc.com; Milliyet; ANF, 11 September).
Seventy-seven people in Van Province, 54 in Batman in Province, 94 in İstanbul Province, 6 in Çorlu District of Tekirdağ Province, 10 in Bursa Province, 20 in Mersin Province, and 17 in Nusaybin District of Mardin Province were detained in connection with propagandising boycott in the referendum on 12 September 2010 (ntvmsnbc.com, 12 September).
Unidentified people threw petrol bombs to Mimar Sinan Primary School in Mersin Province and four schools in Diyarbakır Province that were used for referendum on 12 September 2010 (Zaman, 12 September).
Two peasants were wounded in the clash between peasants and temporary village guards on casting votes in the referendum in Boydansoy Village of Çınar District of Diyarbakır Province on 12 September 2010 (alinteri.org, 12 September).
Fifteen people were wounded in the attack of temporary village guards on the BDP members who have been monitoring referendum in Dêrgulê (Kumçatı) Municipality of Şırnak Province on 12 September 2010 (alinteri.org, 12 September).
İ.H.Ö., the president of the election box no. 1088 in Direkli Primary School in Şanlıurfa Province, quarrelled with members of BDP and he was hospitalised after the incident on 12 September 2010 (Cumhuriyet, 12 September).
A soldier was wounded in the attack on the military vehicle that was escorting to the vehicle which has been carrying election boxes in Hakkâri Province (Cumhuriyet, 12 September).
Alaattin Kuk (11) was shot from his abdomen by an unidentified person who was celebrating the results of the referendum by firing in Rize Province on 12 September 2010 (Milliyet, 12 September).

Soldier Fevzi Tekir was killed in the explosion of a mine in the rural part of Çırpılı Village of Eruh District of Siirt Province on 12 September 2010 (ntvmsnbc.com, 12 September).
Two temporary village guards were wounded with the explosion of a mine in İkinci Köprü Region in Beytüşşebap District of Şırnak Province on 12 September 2010 (ntvmsnbc.com, 12 September).

The testimonies of witnesses and autopsy reports documented that Soldier Cemal Yalçın who allegedly killed by HPGPeople's Defence Forces (armed wing of the PKK) militants was killed with fire from the Security Directorate as he was trying run away in civilian clothes from the scene of incident as the attack on the Directorate was begun in Dicle District of Diyarbakır Province on 5 August 2010 (Sabah, 11 September).
(09/034) Extra-judicial killing attempt in Tunceli Province…
Pir Ali Ökdemir was shot from his arm by the soldiers who supposed that he was a militant of Kurdistan Workers’ Party’s (PKKKurdish Workers' Party ) armed wing People’s Defence Forces (HPG) after he had fired to the dogs near his barn in Böğürtlen Village of Tunceli Province on 12 September 2010 and hospitalised to Tunceli State Hospital (Zaman, 12 September).

Vedat Keri (18) was killed and Adem Yakar (22) was wounded with soldiers’ fire on the grounds that they smuggled oil from Iran in Saray District of Van Province on 8 September 2010 (ANF, 9 September).
(09/036) Extra-judicial killing in Hakkâri Province…
Police teams interfered the protest against the murder of nine HPG militants in Hakkâri Province on 9 September 2010. A specialised sergeant opened fire to the people around from his car and shot Enver Turan (15) who was collecting sweet from his head in the incident. Enver Turan died in the hospital and the specialised sergeant was arrested on charges of “intentionally killing on 10 September 2010 (ntvmsnbc.com; ANF, 9 September; Gündem, 10 September).

Mehmet Toprak (10), Adnan Kurt (9), Yalçın Ertaş (8) and Şükrü Yıldırım (7) were wounded with the explosion of the object they found in the vicinity of Dağdöşü Village of Eruh District of Siirt Province on 9 September 2010 (ANF, 9 September).

Marmara University’s student Bilgihan Şimşek attacked on BDP’s Diyarbakır Deputy Akın Birdal in the referendum meeting in Bursa Province on 10 September 2010. Bilgihan Şimşek was pacified by the people nearby (Radikal, 10 September).

Six people were wounded in the quarrel that started after the temporary village guards stopped the wedding convoy that was passing from Rezuk Village of Başkale District of Van Province and attempted to make identity check and confiscate the scarves in yellow, red and gree colour on 10 September 2010. (09/040) Police officers charged with torture…
D.E. was detained by civil officers who suspected that he was a thief as he went to Saturdar Bazaar with his family in Bakırköy District of İstanbul Province on 3 March 2010. He was beaten in the police vehicle and in Osmaniye Police Station after the identity check officers apologised from him and said that he was that because he looked like a Roma people reported on 8 April 2010.
The indictment which was prepared with the official complaint was finalised reportedly on 9 September 2010. Bakırköy Heavy Penal Court No. 6 accepted the indictment of Bakırköy Chief Public Prosecution Office against the police officers Emel Şenel Soylu and Yakup Şahin on charges of “torture” and Yakup Şahin on charges of “misconduct in office” (Sabah, 9 September).

The guardians of the Tekirdağ F Type Closed Prison No. 2 raided on the room that the exam of the distant education was held 20 minutes after the start and confiscated the papers of 40 prisoners on 4–5 September 2010 (atilim.org, 9 September).

A case was launched against İsmail Saymaz, a reporter of Radikal Newspaper, in connection with the news titled “Love Games in Ergenekon” published on 8 June 2010 reported on 8 September 2010. The indictment was prepared with the complaint of Köksal Şengün, the chairperson of İstanbul Heavy Penal Court No.13, on charges of “insulting”, “breaching the confidentiality of the investigation” and “attempting to influence fair trial” under Articles 125, 285 and 288 of TPCTurkish Penal Code . The prosecutor asked for an imprisonment up to 11 years and 6 months in the indictment which was accepted by Bakırköy Penal Court of First Instance No. 2 and the first hearing will be held on 28 January 2010 (bianet.org, 8 September).

The group that came from Bahçesaray District of Van Province and gathered in front of the van Governorate on the grounds that they could not receive “the money for village restitution” demanded to talk with Van Governor Münir Karaloğlu and the AKP’s Van Deputy Gülşen Orhan. Law-enforcement officers interfered the group with pepper gas and batons and four of them detained and then released with the protest of the group (Günlük, 8 September).

Diyarbakır Heavy Penal Court No. 4 sentenced Mehmet Menteş and Mehmet Akçın to 12 months of imprisonment each in connection with the SMS they sent in Diyarbakır Province on 1 September 2007 on charges of “making propaganda of an illegal organisation” under Article 7/2 of Fighting with Terrorism Law on 11 September 2010 (Gündem, 11 September).

Ten people (two deputies, five police officers) were wounded and 20 people were detained in the intervention of the law-enforcement officers with pepper gas to the public statement of the BDP in Van Province on 8 September 2010.
