(11/037) Clash in İstanbul Province…
Two people clashed with the police team in an identity check point after the “stop” warning of the officers in Avcılar District of İstanbul Province on 8 November 2009. Officer Ufuk Eren (27) and two people were wounded in the incident and they shouted “Long live our party Marxist Leninist Communist Party (MLKPMarxist-Leninist Communist Party )” (atilim.org; ntvmsnbc.com, 8 November).
(11/038) JİTEM Case on extra-judicial killings in Cizre District…
Diyarbakir Heavy Penal Court No. 6 went on hearing the case against Kayseri Province Gendarmerie Commander Major Cemal Temizöz –who had been Gendarmerie Commander of Cizre District between 1993 and 1996- and six other people who had been arrested on 25 April 2009 in connection with the murders by unknown assailants in 1990s in on charges of “inciting homicide” and “being a member of an armed organisation” in connection with 20 murders on 6 November 2009. The Chief Public Prosecution Office asked for life sentence in solitary confinement and with no possibility of parole for nine times for Temizöz.
Hanım Cindoruk, the wife of Ömer Cindoruk who was killed in 1993, claimed that her husband had been killed by Bedran, Abdulhakim Güven ve Captain Cemal (Temizöz) with several bullet holes in his body and their car which had been used as a taxi was stolen after the incident and she saw the informants as driving their car.
Leyla Gasyak, the wife of Süleyman Gasyak who was killed on 8 March 1994, said that Abdulhakim Güven and Adem Yakın killed her husband pointing the defendants.
Major Cemal Temizöz apologised from the relatives of the victims underlining the fact he was responsible for the security of them at that time.

(11/039) Tried human rights defender…
On 9 November 2009 Ankara Heavy Penal Court No. 11 began to hear the case against the member Executive Committee of the Human Rights Association (IHD), Filiz Kalayci, HRAHuman Rights Association ’s Vice Secretary General Hasan Anlar, former member of Executive Board of HRA Halil İbrahim Vargün, human rights defenders Lawyer Murat Vargün and Solidarity Association of the Families of the Prisoners’ (THAY-DER) former President Nedim Taş. Prosecutor accused the five defendants with “being a member of an illegal organisation (PKKKurdish Workers' Party /Kongra-Gel)”. Public statements, Newroz Celebrations, phone conversations and the documents which were confiscated from the houses and offices of the defendants were shown as evidences in the indictment.
Filiz Kalayci stated that if all the allegations were taken into consideration together they are contradictory in nature.
The court adjudicated to prolong the detention process and postponed the hearing to 28 January 2010.
Filiz Kalayci, has been arrested on 27 May 2009. Kalayci is one of the four lawyers who were arrested on 12 May 2009 on charge of “helping and harbouring an illegal organisation”. When the four lawyers were released the Public Prosecutor appealed against the decision of the Ankara Heavy Penal Court No. 11. Within the context of this appeal the public prosecutor issued a warrant of arrest on 25 May 2009. When Kalayci went to Ankara Court House to deal with the files of her own clients, she was detained by police forces and taken before the Court. Then the Court made a decision of arrest against her and she was sent to the prison (ANF; TİHV, 9 November).
(11/040) Extra-judicial killing in Tokat Province…
Zile Heavy Penal Court began to hear the case against the police officer Mehmet Saç who shot death Mustafa Uslu (38) on the grounds that he did not obey “stop” warning in Turhal District of Tokat Province on 10 July 2009. Surveillance camera footages were watched in the hearing and it is reported that Mehmet Saç intentionally opened fire by aiming his firearm despite the testimony of the officer that his gun accidently was fired (Sabah, 9 November).
(11/041) Tried radio and newspaper workers…
On 6 November 2009 Istanbul Heavy Penal Court No. 10 went on hearing the case against 23 defendants who were workers of Free Radio and Atılım Newspaper that had been detained in the operation against Marxist Leninist Communist Party (MLKP) in Istanbul and Izmir Provinces on 10 September 2006. The court adjudicated to prolong the detention process of the 15 pre-trial detainees and postponed the hearing to 26 March 2010 (atilim.org, 6 November).
(11/042) Tried students…
On 6 November 2009 Ankara Heavy Penal Court No. 11 began to hear the case against the 14 students of Middle East Technical University (METU) -Fatih Seçkin Şiş, Kamer Doğan, İlhan Arslan, Tuba Mumcu and Barın Kaya are pre-trial detainees who had been arrested on 28 February 2009- in connection with the incidents in which students decipher an officer of Gendarmerie Intelligence and Fighting with Terrorism Department (JITEM) in the university on 19 January 2009 on charges of attending public statements and meetings, participating in trade union2s activities, selling newspapers etc. The court adjudicated to prolong the detention process and postponed the hearing to 4 February 2010 (ozgurradyo.com, 6 November).
(11/043) Violence in high school…
M.K. (14), a student of Hürriyet Technique Industrial Vocational High School in Kayseri Province, claimed that he had epilepsy crisis after he was beaten by the mathematics teacher of the school F.Ç. in the toilets on the grounds that he was joking with his friend in the corridors of the school on 6 November 2009. Judicial and administrative investigations were launched against the teacher (Milliyet, 7 November).
(11/044) Coercion in prison…
The caricatures of Barış İnan and Gökhan Gündüz were confiscated by the administration of Kandıra (Kocaeli) 1 Nolu F Type Closed Prison on the grounds that they are “inappropriate” reported on 8 November 2009 (Birgün, 8 November).
(11/045) Intervention to the Protest against YÖK …
Police teams interfered to the protest against the Higher Education Council (YÖK) which was founded on 6 November 1981 with gas bombs and batons and detained two students in Ankara Province (Zaman, 6 November).
(11/046) Attack on party building…
An unidentified person attacked on Democratic Society Party’s (DTP) Konya District Branch office and made the workers write on a paper that “People who are sure that they are Kurdish leave their Turkish identity cards to where they had taken and get their own Kurdish identities. If the violence goes on it will be reciprocated” by using a knife and signed the paper as “Zagos” on 6 November 2009 (Gündem, 6 November).
(11/047) Attack on party building…
Unidentified people threw stones to DTP’s Tuzla District Branch office in İstanbul Province on 8 November 2009 and caused material damage (ANF, 8 November).

Six members of the Youth Federation were detained as they were hanging the posters of “Go away USA this is our country” campaign in Okmeydanı Quarter of İstanbul Province on 9 November 2009 (halkinsesi.tv, 9 November).
