(07/051) Operations and clashes in South-east…

The soldier Vahdettin Kaya who had been abducted on the road between Bitlis and Diyarbakır Provinces on 21 June 2012 was reportedly escaped during the operation to save him on 4 July 2012.

(07/052) The case on the death in prison shuttle…

Abdülsetter Ölmez (35), Sinan Aşka (18), İsmet Evin (33), Akif Karabalı (24) and Medeni Demir (47) had lost their lives due to the fire, in prison shuttle which has been carrying them from Van Province to İstanbul, started in the vicinity of Pınarbaşı District of Kayseri Province on 16 September 2011.

Kayseri Heavy Penal Court No. 1 accepted the indictment against the commander and vice commander of the gendarmerie team “causing the death of more than one person with negligence” and the first hearing will be held on 1 October 2012.

(07/053) Violence in Quoran Course…

M.Ö. (13) was beaten by the responsible person (İ.S.) of the Quoran Course of the Köyceğiz Private Student Dormitory for Males and his arm was fractured in the incident in Köyceğiz District of Muğla Province on 28 June 2012.

(07/054) Convicted persons…

On 5 July 2012 Diyarbakır Heavy Penal Court No. 4 sentenced 11 defendants to 7 years and 1 month of imprisonment each on charges of “being a member of an illegal organisation” under Article 314 of TPCTurkish Penal Code and “making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law and another defendant to 9 years of imprisonment with the same charges.

Twelve defendants had been detained in the raid on the Democratic Solution Tent in Kızıltepe District of Mardin Province on 28 March 2011 and then eventually arrested.

(07/055) Ongoing KCK/TMKCK Par lament Turkey Main Case in İstanbul Province…

İstanbul Heavy Penal Court No. 15 went on hearing the case against 205 defendants -140 of them pre-trial detainees and 23 of them were fugitives- on 5 July 2012.

The court declined all the demands of the lawyers except the reading of the whole indictment and adjourned the hearing to 6 July 2012. Istanbul Chief Public Prosecution Office had finalised the indictment against 193 people -147 of the pre-trial detainees- who had been detained in various dates in the framework of KCKUnion of Communities in Kurdistan investigation and sent the 2401 pages of indictment for the evaluation of Istanbul Heavy Penal Court No. 15 on 19 March 2012. Writer Ragıp Zarakolu had been charged with “helping and harbouring an illegal organisation” under Article 220/7 and Prof. Dr. Büşra Ersanlı had been charged with “being an executive of illegal organisation”.

İstanbul Heavy Penal Court No. 15 released Writer Ragıp Zarakolu, Muhsin Yenisöz, İrfan Hülakü, Lütfü Balbal, Ali Geritli, Songül Karatagna, Nahit Onat, Zeynal Çelik, Neci Elmas, Burhanettin Toprak, İsmail Zeybek, Evrim Öztürk, Yasin Yalçın, Cemalettin Görbegir, Alaattin Güneş on the grounds that the probability that the qualification of the charges could be change and the conditions of the evidences as well as taking the period of time spent in prison as pre-trial detainees.

(07/056) Finalised KCK investigation in Ankara Province…

Ankara Chief Public Prosecution Office had finalised the indictment against 15 female trade unionist and charged them with “being a member of an illegal organisation” under Article 314 of TPC “making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law and sent the indictment to Ankara Heavy Penal Court No. 11 to be evaluated on 14 June 2012.

Ankara Heavy Penal Court No. 11 accepted the indictment on 2 July 2012 and the first hearing will be held on 24 October 2012. Fifteen trade unionist had been detained in Ankara Province on 13 February 2012 in the framework of KCK investigation and nine of them were arrested KESKConfederation of Trade Union in the Public Sector Women Secretary Canan Çalağan, Eğitim-Sen Branch No. 1’s member Hatice Beydilli, SES Ankara Branch’s Women Secretary Nurşat Yeşil, KESK’s former executive Belkıs Yurtsever, Tüm Bel-Sen Women Secretary Güler Elveren, SES Women Secretary Bedriye Yorgun, Eğitim Sen Branch No. 1’s member of Evrim Oğraş, SES Ankara Branch Executive Hülya Mendilligil, Eğitim-Sen Branch No. 2’s Women Secretary Güldane Erdoğan while 6 of them had been released KESK’s former Women Secretary Songül Morsümbül, BES’s member Leman Kiraz, Eğitim-Sen Ankara Branch’s member Meral Hız, Eğitim-Sen Ankara Branch’s members Nezahat Aslan and Şefika Şimşek on 17 February 2012.

(07/057) Tried persons in connection with a translated novel…

Sultanahmet Penal Court of First Instance No. 2 went on hearing the case against the owner of the Sel Publishing house İrfan Sancı and the translator of The Soft Machine by William S. Burroughs, Süha Sertabiboğlu, on the grounds that the novel is obscene on charges of “obscenity” under the Article 226 of the TPC on 5 July 2012.

The court adjudicated to postpone the prosecution against the defendant basing its verdict to the Temporary Article 1/1-b of the Law No. 6352 which came into force as a part of the third Judiciary Reform Package on 5 July 2012.

(07/058) Tried persons in connection with a translated novel…

Sultanahmet Penal Court of First Instance No. 2 wen on hearing the case against Funda Uncu, The translator of the Chuck Palahnıuk’s Snuff/Ölüm Pornosu into Turkish, Hasan Basri Çıplak the owner of the Ayrıntı Press in connection with publishing the above-mentioned novel on charges of “obscenity” on 5 July 2012.

The court adjudicated to postpone the prosecution against the defendant basing its verdict to the Temporary Article 1/1-b of the Law No. 6352 which came into force as a part of the third Judiciary Reform Package on 5 July 2012.

İstanbul Heavy Penal Court No. 16 adjudicated to postpone the prosecution -basing its verdict to the Temporary Article 1/1-b of the Law No. 6352 which came into force as a part of the third Judiciary Reform Package on 5 July 2012- against the 8 defendants -Ali İhsan Bingül, Aydın Kürekçi, Emrullah Bingül, Gülşehri Eniş, Hüngar Hüday Karasungur, Nahide Kılıç, Süleyman Özcan ve Veli Büyük- who has been tried on charges of “making propaganda of an illegal organisation” under Article 7/2 of Anti-Terror Law on 5 July 2012.

(07/060) Convicted person…

Van Heavy Penal Court No. 3 sentenced Yasin Anman (19)to 21 years and 8 months of imprisonment although the prosecutor asked for his imprisonment up to 14 years on charges of “opposing to the Law No. 2911 on Meetings and Demonstrations”, “having explosives”, “resisting public officers on duty”, “making propaganda of an illegal organisation” under Article 7/2 of Fighting with Terrorism Law and “committing offence on behalf of an organisation although he is not a member” under Article 220/6 of TPC, “restricting the freedom of work” on 5 July 2012.

Yasin Anman (19) had been detained in the protest in Van Province on 18 May 2011. The court declined the demand of the defendant to make their legal argument in Kurdish.

(07/061) Tried lawyer…

Silivri Penal Court of First Instance No. 1 accepted indictment against Hasan Basri Özbey the lawyer of Doğu Perinçek, the chairperson of the Workers’ Party, who has been tried in the first Ergenekon case in connection with his speeches he made during the hearings on charges of “insulting the public officers” under Article 125 of the TPC on 5 July 2012.

(07/062) KCK operation in Diyarbakır Province…

Ten out of the twenty-one people –including BDPPeace and Democracy Party ’s Dicle District Chairperson Cemal Sert- who had been detained in the raids on Dicle Municipality, BDP’s District office and houses with the order of Diyarbakır Chief Public Prosecution Office in Dicle District of Diyarbakır Province on 4 July 2012 were arrested in the framework of the KCK investigation on 5 July 2012.

Nine people including Mayor Mustafa Uyguner have reportedly warrants for their arrest.

(07/063) Home raid in Ağrı Province…

Two persons were detained in home raids in Doğubayazıt District of Ağrı Province on 5 July 2012.
