(09/011) Ongoing JİTEM case…

First hearing after the unification of the two Gendarmerie Intelligence and Fighting with Terrorism Department (JITEM) cases –one with 15 defendants in connection with the murder by unknown assailants, sabotage and bombing incidents that took place in Diyarbakır, Mardin, Batman and Şırnak Provinces between 1989 and 1994 and one with five defendants including Mahmut Yıldırım and informant Abdülkadir Aygan in connection with the murder of eight people in Diyarbakır Province between 1992 and 1994- the first hearing was held in Diyarbakır Heavy Penal Court No. 6 on 3 September 2010.

Informant Ali Ozansoy and Adil Timurtaş who is a pre-trial detainee from a case in Istanbul Province attended the hearing for the first time and declined to give legal arguments due to the absence of their lawyers. The court adjudicated to take the legal arguments in the next hearing in the presence of the lawyers.

Ministry of Interior Affairs informed the court on the new names of the informants -Ali Ozansoy, Hüseyin Tilki, Fethi Çetin and Kemal Emlük- that were changed due to “security”.

According to the ministry Ali Ozansoy’s new name is Ahmet Turan Altaylı, Fethi Çetin’s is Fırat Can Eren, Hüseyin Tilki’s is Hüseyin Eren and Kemal Emlük’s is Erhan Berak.

The court declined the arrestment of the defendants and adjudicated to write to the Security General Directorate for the addresses of the defandants and adjourned the hearing (Gündem, 3 September).

(09/012) Ill-treatment by private security officers…

Fikret Ceylan (28) was beaten by private security officers of the Göztepe Training and Survey Hospital Kadıköy District of İstanbul Province on 5 September 2010. The quarrel began after the officers did not allowed Fikret Ceylan (28) to visit his son Furkan Ceylan (7) in the hospital. Fikret Ceylan got a report that documents that he is unable to work for five days (Zaman, 6 September).

(09/013) Coercion in prison…

The administration of the Kürkçüler (Adana) F Type Closed Prison began to demand “translator’s fee” to send the letters of the prisoners in Kurdish and did not give the letters that were sent to the prisoners reported on 5 September 2010 (ANF, 5 September).

(09/014) Coercion in prison…

The administration of Kandıra (Kocaeli) F Type Closed Prison No 1 sentenced 8 prisoners to ban of social activities for 45 days each on the grounds that they protested the solitary confinement sentence given to Yüksel Yiğitdoğan reported on 5 September 2010 (ANF, 5 September).

(09/015) Restriction of access to website…

Telecommunication Communication Presidency (TİB) restricted the access to the website, playboy.com, as an administrative measurement on 6 August 2010 reported on 6 September 2010 (Radikal, 6 September).

(09/016) Human rights violations and attacks in the process of Referendum on 12 September 2010…

The posters of the Peace and Democracy Party (BDPPeace and Democracy Party ) were covered with white clothes before the meeting of Prime Minister Recep Tayyip Erdoğan in Diyarbakır Province on 3 September 2010 (ANF, 3 September).

Dicle News Agency (DİHA), Fırat News Agency, Günlük Newspaper, Azadiya Welat Newspaper and Roj TV were not allowed the report the meeting (ANF, 3 September).

Eight members of the Student Initiative threw eggs to speakers in the meeting organised by the group “Not-Enough But Yes” on the grounds that they did not let them speak in the meeting in İstanbul Province on 4 September 2010. One of the eggs hit Osman Can (ntvmsnbc.com, 4 September).

Police teams imposed a fine of 1500 TL to five people according to the Law of Petty Offences in connection with the posters hanged by the Assembly of the Socialist Women of Socialist Party of the Oppressed’s (ESP) Gaziantep Province Branch on 3 September 2010 (atilim.org, 4 September).

Viranşehir District Election Board imposed a fine of 228,92 TL on the Viranşehir (of Şanlıurfa Province) District Branch of BDP and decided to confiscate the posters on 3 September 2010 (Günlük, 4 September).

Three members of the Freedom and Solidarity Party (ÖDPParty for Peace and Solidarity ) protested the speakers in the meeting that was organised by the group “Not-Enough But Yes” saying that “you cannot talk about the revolutionists” and poured the paint on the speakers on 5 September 2010 (Milliyet, 5 September).

Unidentified people attacked on the members of the Worker Party (İşçi Partisi) as they were handing out leaflets with “Say No to the Constitutional Amendment” phrase and wounded nine of them in Belek Municipality of Antalya Province on 5 September 2010 (Radikal, 5 September).

Municipal police of Gaziantep Municipality hindered the stand of the Communist Party of Turkey (TKP) on 5 September 2010 (Cumhuriyet, 5 September).

(09/017) Fighting with Terrorism Law in practise…

Peace and Democracy Party’s (BDP) Ceyhan District Branch Executives Mevlüt Yılmaz and Cemal Nas, and Salih Biliç who had been detained in home raids in Ceyhan District of Adana Province on 4 September 2010 were arrested on charges of “making propaganda of an illegal organisation” on 5 September 2010 (Gündem, 5 September).

(09/018) Detentions and arrests…

Six out of the 13 detainees, who had been detained in Doğubayazıt District of Ağrı Province in connection with the funeral of the militant Şeyma Yılmaz who was killed in the clash in the rural part of Şemdinli District of Hakkâri Province, were arrested on charges of “making propaganda of an illegal organisation” on 4 September 2010 (Milliyet, 4 September).
