On 2 February 2012 İzmir Heavy Penal Court No. 10 sentenced the Socialist Party of the Oppressed’s (ESP) İstanbul Province Branch Chairperson Hülya Gerçek, ESP’s İzmir Province Branch Chairperson Meliha Kayacı, and Görgü Demirpençe 12 years of imprisonment; ESP members Vahap Biçici and Aydın Akyüz to 22 years of imprisonment on charges of “being a member of an illegal organisation –Marxist Leninist Communist Party” under Article 314 of TPCTurkish Penal Code . Six people were acquitted in the case. After the verdict Hülya Gerçekwho had been detained in İstanbul Province on 4 February 2012 was arrested the same day (atilim.org, 4 February).

Diyarbakır Heavy Penal Court No. 5 went on hearing the case against 106 defendants -98 Mayors and 8 Province General Assembly Chairperson in connection with the public statement on the prison conditions of Abdullah Öcalan in Diyarbakır Province on 4 December 2009 on charges of “being a member of an illegal organisation” under Article 314 of TPC and “committing offence on behalf of an organisation although he is not a member” under Article 220/6 of TPC on 3 February 2012.
The court declined the demand of the 13 defendants to make their legal arguments in Kurdish and adjourned the hearing (Cumhuriyet, 3 February).
(02/030) JITEM trial related to killings of unknown assailants in Cizre…
On 3 February 2012 Diyarbakır Heavy Penal Court No. 6 continued to hear the case of 7 defendants, members of JITEM (Gendarmerie Intelligence and Fight against Terrorism) charged with 20 killings that had been committed between 1993 and 1995 when Cemil Temizöz had been the commander of Cizre Gendarmerie Station in Şırnak province, Cizre district. It was the 33rd hearing.
Cemal Temizöz had claimed that he had been in foreign countries at the time of the incidents. Turkish Airlines made a written statement and announced that they keep the records for ten years and they do not have records for 1994.
The Head of the Temporary Village Guards Kamil Atak said in the hearing that “the intelligence –MITNational Intelligence Organization - has been talking against him. There is something that he knows and if he would talk everything will be upside down.
The court heard the written arguments of the defendants and adjourned the hearing (Zaman, 3 February).

İzmir Heavy Penal Court No. 8 sentenced five Akdeniz University students -Dündar Argül, Servat Akdağ, Mehmet Demir, Cemal Karaçalı and Celal Karabulut- to ten months of imprisonment each in connection with shouting illegal slogans in front of a gendarmerie headquarters in Antalya Province in 2011 on charges of “making propaganda of an illegal organisation” under Article 7/2 of Fighting with Terrorism Law reported on 5 February 2012 (Özgür Gündem, 5 February).

Forty-one people –including Dicle News Agency’s (DİHA) Batman reporter Gülsen Aslan, and executives of NGOs- were detained in the raids of the Fighting with Terrorism Department teams on the houses and institutions in Batman Province on 4 February 2012 (DHA, 4 February).
BDPPeace and Democracy Party ’s Women’s Assembly member Gülistan İnan was detained in the home raid in Varto District of Muş Province on 4 February 2012 (DİHA, 4 February).
Maşallah Ata and Abdurrahman Ata, two members of the BDP were detained in the home raids in Güroymak District of Bitlis Province on 4 February 2012 (ANF, 4 February).

12 out of the 24 people who had been detained in the raids of the Fighting with Terrorism Department teams on the houses in Kocaeli Province in the morning of 22 November 2011 were arrested on charges of “making propaganda of an illegal organisation in various meetings” on 25 November 2011. The objections of the lawyers of the pre-trial detainees were accepted and 12 of them were released on 3 February 2012 (Radikal, 3 February).
