Musa Dönmez was killed on the grounds that he did not obey the “stop” warning in Etmesgut District of Ankara Province on 1 October 2009 (ozgurradyo.com, 3 October).
(10/023) Person hit by a Police motorbike…
Ali Kaya died after he was hit by a police motorbike as he was trying to cross the street in İstanbul Province on 2 October 2009. Two police officers were wounded in the incident (ntvmsnbc.com, 2 October).
(10/024) Operations and clashes in South-east…
Two soldiers were wounded in the explosion of a bomb as a military vehicle passing by in Küçüksu Village Tatvan District of Bitlis Province on 3 October (Zaman, 3 October).
A temporary village guard was killed and three soldiers were wounded in the operations in Cudi Mountain Region in Şırnak Province on 2 October (ANF, 2 October).

Vedat Bayhan (26) and Cihat Durmuş (16) died in the explosion of a mine as a minibus passing by that has been carrying military supply to the army unit in the Kato Mountain in Şırnak Province on 4 October (Zaman, 4 October).

Nine cattle were killed with the explosion of a mortar shell in Ataçınar Village of Mazgirt District of Tunceli Province on 3 October 2009. The shepherd Niyazi Şahin did not wounded in the incident (Zaman, 3 October).
(10/027) Arrestment decision in the murder by unknown assailants in Şırnak Province…
On 3 October 2009 Zeki Akdoğan was arrested on charges of killing Democratic Society Party (DTP) members Necman Ölmez and Ferhat Erdiş in Günyüzü Village of Beytüşşebap District of Şırnak Province on 25 July 2009. It is claimed that Zeki Akdoğan had confessed the murders. Seven temporary village guards were detained and law enforcement officers have been searching 13 other people after his testimony (Radikal, 5 October).
(10/028) The Case of Ferhat Gerçek…
On 2 October 2009, Bakirköy Heavy Penal Court No. 9 went on hearing the case against the 13 defendant -7 of them police officers- who have been tired in connection with wounding Ferhat Gerçek in Yenibosna District of Istanbul Province on 7 October 2007. The court declined the arrestment the police officers which was demanded by the lawyers of Gerçek. The hearing was postponed to 12 February 2010 (Birgün, 3 October).

Eight out of the 17 people -Ulaş Erdoğan, Yaşar Kaygın, Onur Sarıefe, Cenk Büyükkahraman, Volkan Karakoç, Murat Akıncılar, Gökhan Aydın and Barış Kaygın- who had been detained in synchronised operations in four cities on 30 September 2009 were arrested on charges of “being a member and executive of an illegal organisation” on 3 October 2009 (Zaman, 3 October).

Turkish General Staff announced eight different “temporary military security zones” in Dicle District of Diyarbakır Province between 19 September 2009–19 December 2009 on 3 October 2009 (atilim.org, 3 October).
(10/031) Excessive use of force by law enforcement officers…
Güney Tuna (21) was beaten by police officers in the quarrel between officers and a group that was sitting in Mustafa Burcu Park in Avcılar District of İstanbul Province on 3 October 2009. Officers also went on beating Güney Tuna in Avcılar Central Police Station. Güney Tuna was hospitalised after he was released from the station and it is reported that there is still danger of life (Posta, 4 October; Radikal, 5 October).

Ministry of Interior Affairs sentenced six police officers with suspension of seniority for 16 months in connection with beating the family of Mehmet Şah Aras with batons in İstanbul Province on 30 October 2008 (Radikal, 5 October).

Eight people –four of them prisoners- were wounded in the intervention of the soldiers and guardians to the riot of the prisoners on the grounds that the prison is overcrowded in the T Type Prison in Oltu District of Erzurum Province on 2 October 2009 (Yeni Şafak, 3 October).

Ağrı Law Court of First Instance sentenced 10 people to 15 months of imprisonment each on charges of “making propaganda of an illegal organisation” under Article 7/2 of Fighting with Terrorism Law and 55 people to read books for three months under Article 152 of TPCTurkish Penal Code . Defendant Mirza Şen was acquitted in the case. Sixty six people had been detained in the intervention to the group that was waiting for the election results in Ağrı Province on 29 March 2009 and later a case was launched against them on charges of “making propaganda of an illegal organisation” and “harming public goods” (Gündem, 3 October).

Diyarbakir Heavy Penal Court No. 2 went on hearing the case against HRFTHuman Rights Foundation of Turkey ’s Diyarbakir Representative and former chairperson of Diyarbakir Bar Association Sezgin Tanrikulu and Nesip Yildirim in connection with the agenda they published both in Turkish and in Kurdish in 2007 on charges of “misuse in duty” under Article 257 of TPC on 2 October 2009. The court decided to ask the publisher whether the Bar Association paid an additional cost for the Kurdish letters (LNA, 2 October).

Bakırköy Chief Public Prosecution Office decided nolle prosequi in the investigation that was launched on 22 September 2009 against the interview of Milliyet Newspaper’s writer Devrim Sevimay with actress Hülya Avşar on the “democratic initiative” which was publiched in the newspaper on 24–25 August 2009 on charges of “inciting people to hatred and enmity” under Article 216 of TPC (Radikal, 3 October).
